Roll Call Training

Although this case is based out of New Jersey, It discusses key points reflected throughout the United States regarding the search of vehicles and when Miranda is necessary during traffic stops.

Overview:

In NJ v Dale Edwards, the officer searched the vehicle revealing Methamphetamine and a loaded 9mm handgun. The defendant appealed, and the NJ Superior Court (Appellate) examined the facts to examine several legal issues:

Was the stop lawful? If so, was the extension of the stop supported by Reasonable Articulable Suspicion?

Was there Probable Cause to Search the vehicle?

Lastly, should the defendant have been advised of his Miranda Rights and should the statements be suppressed?
